After researching through court records and investigation of the case, criminal appeal attorney Jacob Blizzard discovered that both of Mr. Weiershausen’s attorneys rendered ineffective assistance of counsel for:
- Failing to advise him of the correct range of punishment
- Not objecting to the court’s change of the judgment after the fact…
- And failing to advise him of his right to appeal.
Blizzard filed an 11.07 Application for Post-Conviction Writ of Habeas Corpus alleging ineffective assistance of counsel.
The trial court agreed and issued favorable findings of facts and conclusions of law.
The Court of Criminal Appeals agreed with the trial court’s finding, overturning his conviction, and granted Mr. Weiershausen a new trial.
